Terms of Use
Last updated October 20, 2026
These Terms of Use ("Terms") are a binding agreement between you and Toadstool Labs LLC ("Toadstool Labs", "we", "us") and govern your use of Ramble, including our website, events, quests, payouts, and related services (the "Service"). By creating an account or using the Service you accept these Terms. If you use the Service for a company or studio, you accept them for that organization and confirm you have authority to bind it. If you do not agree, do not use the Service.
1. Who can use Ramble
- You must be at least 18 years old, or the age of majority where you live, whichever is higher.
- You must give accurate information and keep it current. One person, one account.
- You may not use the Service if you are barred by law, are on a government sanctions list, or live where participating in paid content or prize events is prohibited. Events are void where prohibited.
2. Accounts and verification
You are responsible for activity on your account and for keeping access to your email secure. We may verify your identity, the channels you list, and their audience at any time, and we may refuse, limit, or remove an account or channel we cannot verify. Verification is for our records only and is not an endorsement.
3. Fair play: no cheating and no fake engagement
Ramble only works when results are real. When you take part in any event, quest, or other opportunity you must not:
- cheat in any event or game, including using hacks, exploits, macros, bots, modified clients, scripted inputs, account sharing, collusion, win trading, or anyone else playing for you;
- game any content or viewing threshold, including buying or trading views, followers, likes, comments, watch time, or subscribers; using bots, view farms, click farms, engagement pods, misleading thumbnails or titles made to inflate numbers, or any other artificial or incentivized engagement;
- submit content, scores, screenshots, links, or analytics that are false, edited, borrowed, or misleading;
- create multiple accounts or enter the same event more than once.
Breaking this section results in a ban from the Service. When we ban an account for cheating or fake engagement we may also cancel any pending payouts and prizes, recover amounts already paid as a result of the violation, and share relevant information with the affected studio and, where required, with platforms or authorities. We decide in our reasonable discretion whether a violation happened, and we may use automated and manual review to do so.
4. Creators and players
- Expressing interest in a quest or event is not a guarantee of selection. Studios decide who takes part. If you are not selected you will be told the opportunity is not available; we do not share studio feedback.
- A payout is earned only when the studio and Ramble confirm you met the stated requirements. Prizes are earned only from final, published results.
- Payouts are sent through our payment processor, Stripe. You must complete Stripe's onboarding and accept its terms to receive money. Payouts may be delayed while we review results or investigate a possible violation.
- You are an independent contractor, not an employee or agent of Toadstool Labs or any studio. You are responsible for your own taxes, and you must give us any tax forms we ask for. We may withhold payment until you do.
- You must follow the rules of every platform you publish on, including disclosing paid or sponsored content as required by law and by those platforms (for example, the U.S. FTC Endorsement Guides).
- What you earn on Ramble is private. We do not show it to other users.
5. Studios
- When you publish a quest or event you agree to fund it in full, plus Ramble's service fee shown at checkout, before it goes live. You authorize us to collect those amounts through Stripe.
- Funds for a quest or event are held to pay participants. Once a participant has been approved or results are published, the matching funds are non-refundable. We may, at our discretion, refund or credit unused funds from a cancelled quest or event, less fees already incurred. Service fees are non-refundable.
- You are responsible for the accuracy of your quest and event descriptions, rules, prizes, and requirements, and for having the rights to any game, key, build, or asset you provide. You must not ask creators to do anything unlawful, deceptive, or against platform rules, including hiding a sponsorship.
- Reasons you give when you pass on a creator are for Ramble only. They are never shown to the creator. We use them to improve your matches.
- You may not contact Ramble creators to arrange paid work outside the Service to avoid our fees for 12 months after you are introduced.
6. Content and licenses
Creators keep ownership of the content they make. For each quest or event you take part in, you grant the studio that runs it and Toadstool Labs a worldwide, royalty-free, non-exclusive license to view, link to, embed, and share that content, and your name and channel, to promote the game and the Service, unless the quest says otherwise. Studios grant creators a limited license to play, record, stream, and publish footage of their game for the opportunity. You grant us a license to host and display what you submit to operate the Service. You confirm you have the rights needed to grant these licenses.
7. Acceptable use
Do not use the Service to break the law; harass, threaten, or discriminate against anyone; post sexual content involving minors, hateful, or violent extremist content; infringe anyone's rights; send spam; scrape or reverse engineer the Service; interfere with its security or operation; or impersonate anyone.
8. Suspension and termination
We may suspend or end your access at any time, with or without notice, if we believe you broke these Terms, created risk or legal exposure for us or others, or if we stop offering the Service. You may close your account at any time. Sections that by their nature should survive termination will survive.
9. Third-party services
The Service relies on third parties such as Stripe and the platforms where content is published. Their terms govern your use of them and we are not responsible for their acts or availability.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT PERMITTED BY LAW, TOADSTOOL LABS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE ANY AMOUNT OF EARNINGS, EXPOSURE, VIEWS, SALES, OR RESULTS, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. WE DO NOT CONTROL AND ARE NOT RESPONSIBLE FOR USERS, GAMES, OR CONTENT.
11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, TOADSTOOL LABS AND ITS MEMBERS, MANAGERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID TO US, OR THE PAYOUTS WE PAID TO YOU, IN THE 12 MONTHS BEFORE THE CLAIM, AND (B) ONE HUNDRED U.S. DOLLARS. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITS, SO THEY MAY NOT APPLY TO YOU.
12. Indemnity
You will defend, indemnify, and hold harmless Toadstool Labs and its members, managers, employees, and agents from any claims, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your content or games, your breach of these Terms, or your violation of any law or third-party right.
13. Disputes and arbitration
Please contact us first at legal@toadstool.tech; most issues are solved that way. If we cannot resolve a dispute within 30 days, you and Toadstool Labs agree to resolve it by binding individual arbitration administered by the American Arbitration Association under its applicable rules, except that either party may bring an individual claim in small-claims court or seek injunctive relief for misuse of intellectual property. You and Toadstool Labs waive any right to a jury trial and to take part in a class, collective, or representative action. You may opt out of this arbitration agreement by emailing legal@toadstool.tech within 30 days of first accepting these Terms.
14. Governing law
These Terms are governed by the laws of the state in which Toadstool Labs LLC is organized and by applicable U.S. federal law, without regard to conflict-of-law rules.
15. Changes
We may update these Terms. If a change is material we will tell you by email or in the Service before it takes effect. If you keep using the Service after a change takes effect, you accept the new Terms.
16. General
These Terms are the whole agreement between you and us about the Service. If any part is unenforceable, the rest stays in effect. Our failure to enforce a right is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
